Statement of Attorney General Bob McDonnell Regarding Governor’s Decision on Percy Walton

“I respectfully disagree with the decision of Governor Kaine to grant yet another reprieve, this time of 18 months, for convicted murderer Percy Walton. At the time of the initial 6-month reprieve I noted that the Governor clearly had the constitutional authority to reprieve sentences and that I respect this authority. However, I am most concerned about the impact today’s action could have on our justice system.

“Multiple judges in multiple court proceedings have found that Percy Walton is competent, is not mentally retarded, and legally permitted to be executed. The decision of whether an inmate meets the constitutional standard for competence to be executed is appropriately placed in the hands of judicial officers who conduct hearings, hear both sides’ evidence and make credibility determinations. There is no similar established procedure for a post-judicial determination of these legal issues in a clemency proceeding. Walton's judgment of execution for the brutal murders he committed in Danville should be carried out, without any further delay. The courts have spoken repeatedly, and justice must be served. We continue to remember the family and friends of Percy Walton’s victims: Jesse and Elizabeth Kendrick, and Archie Moore.”
