Statement of Attorney General Bob McDonnell on Governor’s Delay of Emmett Execution
Governor Kaine has delayed tonight’s scheduled execution of Christopher Scott Emmett for the murder of John Fenton Langley. This delay is based on a petition for certiorari filed by Emmett’s attorneys that has yet to be ruled on by the U.S. Supreme Court. Attorney General Bob McDonnell issued the following statement with regard to the Governor’s action:
“The Governor has the constitutional authority to take this action. Given the procedural posture of this case in the United States Supreme Court, and considering the interests of justice, I respect the Governor’s exercise of this authority.”
